Presidio Education® Terms and Conditions

Introduction

By accessing or using the services provided by Presidio Education®, including educational courses, tutoring, consultation, and all other related services, you ("Client") agree to comply with and be bound by the following Terms and Conditions ("Agreement"). This Agreement is a legal contract between you and Presidio Education® ("we," "our," or "us").

 

Services Provided

Presidio Education® provides a wide range of educational services, including but not limited to, academic tutoring, test preparation, college counseling, extracurricular activities, and educational consultation. All services are subject to availability, and we reserve the right to modify or discontinue services at our discretion.

Client Responsibilities

  1. Accurate Information
    Clients must provide accurate and up-to-date personal, contact, and payment information. Failure to do so may result in delays, cancellation of services, or termination of this Agreement.

  2. Respectful Behavior
    Clients agree to maintain respectful communication with Presidio Education® staff and other clients. Abusive, disrespectful, or inappropriate conduct will not be tolerated and may result in the termination of services without refund.

  3. Punctuality and Attendance
    Clients are expected to attend sessions at the scheduled time. Late arrivals or cancellations with less than 24-hour notice may be subject to a rescheduling fee or forfeiture of the session, depending on the circumstances.

  4. Parent/Guardian Role for Minors
    For clients under the age of 18, parents or legal guardians must be responsible for ensuring the child’s attendance and participation in sessions. Presidio Education® is not responsible for any failure on the part of the parent or guardian to fulfill this role.

Academic Integrity and Ethics

  1. Academic Integrity and Ethical Conduct

    All students enrolled in classes, programs, or competitions through Presidio Education® are expected to uphold the highest standards of academic integrity and ethical conduct at all times. This includes, but is not limited to: 1) Completing original work; 2) Properly citing sources; 3) Avoiding all forms of plagiarism; and 4) Following all program rules and submission guidelines.

  2. Invalid Excuses

    Ignorance, carelessness, or misunderstanding of the rules will not be considered valid excuses for academic misconduct. Students are responsible for reviewing and understanding the expectations outlined in their coursework or competition instructions.

  3. Violations

    Any violation of academic integrity—including plagiarism, fabrication of data, or unauthorized collaboration—will result in immediate disqualification from the program or forfeiture of class participation, with no refund issued under any circumstances.

  4. Compliance

    By participating in any educational program or service offered by Presidio Education®, students and their guardians agree to these terms and acknowledge that compliance with academic standards is mandatory.

Payment and Fees

  1. Fees
    All services provided by Presidio Education® are subject to fees as outlined in the respective service agreements. Full payment is required in advance—prior to class scheduling or confirmation—unless otherwise agreed upon in writing. Please allow reasonable processing time for all payments. For example, credit card payments made outside business hours or international wire transfers may delay scheduling. Presidio Education® cannot guarantee class availability for last-minute payments.

  2. Refunds and Cancellations
    Presidio Education® does not issue refunds under any circumstances. All payments are final and non-refundable.

    Once payment is received, classes are scheduled based on instructor availability. Clients must provide at least 24 hours’ written notice to request a reschedule. Requests made with less than 24 hours’ notice will result in forfeiture of the class, with no make-ups or rescheduling offered.

    Rescheduling is not guaranteed, even when requested with proper notice. Many of our instructors are fully booked months in advance, particularly at the end of each academic term. For example, submitting a reschedule request on December 28 for a December 30 class may still result in forfeiture due to lack of availability.

    In addition, all rescheduled classes must be completed within the same academic term (Summer, Fall, or Spring). Any unused or rescheduled classes that are not completed by the final day of the term will be forfeited. Classes may not be rolled over into a future term under any circumstance.

    Presidio Education® may, at its sole discretion, make exceptions to this policy on a case-by-case basis. However, clients should not expect exceptions to be made.

    No Refund Policy: Services are not refundable once completed. This includes any purchased packages or prepaid sessions.

  3. Payment Methods
    Presidio Education® accepts payment via PayPal and major credit cards, including VISA, MasterCard, Discover, American Express, JCB, and Diner’s ClubBank transfers are also accepted upon request. All payments are processed in United States Dollars (USD).

    Full payment is required before any classes are scheduled or services rendered. Payment must be successfully processed and confirmed by our office prior to class scheduling. Clients should allow sufficient time for payment processing, especially in the case of international wire transfers, which may take several business days.

    Clients are responsible for all processing and banking fees associated with their payment method. In the case of wire transfers, if any fees are incurred on the sending or receiving end (e.g., bank charges, transfer fees, etc.), the client must cover those costs to ensure the full invoice amount is received by Presidio Education®.

    Any fees incurred by Presidio Education® due to insufficient payment will be billed to the client. In addition, Presidio Education® reserves the right to charge a service fee at its discretion to resolve any issues related to insufficient or misdirected payments. This service fee is intended to cover the administrative costs of rectifying the issue and is applied to discourage poor payment practices.

    Presidio Education® is based in San Francisco, California (Pacific Time). Clients should account for time zone differences when submitting payments or requesting class times, particularly when approaching the end of a term or during holidays.

Confidentiality and Privacy

  1. Confidential Information
    Presidio Education® respects the confidentiality of all clients and will not disclose any personal or academic information to third parties without explicit consent, except as required by law. All information shared during sessions is confidential.

  2. Privacy of Student Information
    Presidio Education® is committed to protecting the privacy of our clients in accordance with applicable laws, including the Children’s Online Privacy Protection Act (COPPA). For more information, please refer to our Privacy Policy.

Intellectual Property

  1. Ownership of Content
    All materials provided by Presidio Education® during sessions, including worksheets, study guides, or proprietary content, are the intellectual property of Presidio Education® and are protected by copyright law. Clients are not authorized to reproduce, distribute, nor share these materials without permission.

  2. Use of Trademarks
    Clients may not use any trademarks, service marks, or logos owned by Presidio Education® without express written consent.

Liability and Disclaimers

  1. Limitation of Liability
    Presidio Education® will not be held liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to damages for loss of profits or data.

  2. No Guarantee of Results
    While Presidio Education® is committed to providing high-quality educational services, it is important to understand that we make no guarantees regarding specific outcomes, such as test scores, academic performance, grades, or college admissions. Success in achieving academic or personal goals is inherently dependent on a variety of factors, many of which are beyond our control. These include, but are not limited to, the student's effort, motivation, consistency, and engagement, as well as external factors like the academic environment, family support, and the level of competition in the student's field of study.

    We want to be crystal clearResults are not guaranteed, no matter the amount of financial investment. The belief that paying for premium services automatically translates into guaranteed outcomes such as perfect test scores, straight A grades, or acceptance into top colleges or universities is a misconception. Success in education is a collaborative effort that requires consistent dedication and hard work from both the student and the parents. Simply enrolling in our services or paying for tutoring does not ensure specific academic achievements, especially if the student does not fully participate in the process nor meet the academic demands of the program.

    Presidio Education® works to guide and support students to the best of our ability, but we cannot control nor predict the amount of work a student puts in outside of our sessions. Homework completion, self-discipline, and active participation are imperative for success. Parents and students are strongly encouraged to foster accountability, responsibility, and time management. However, if a student fails to engage in lessons, neglects assigned work, or does not demonstrate the necessary commitment, we cannot be held responsible for unsatisfactory results.

    Furthermore, Presidio Education® is not liable for any negative outcomes arising from missed classes, incomplete assignments, or lack of student progress. We provide resources and support, but the ultimate responsibility lies with the student and the family.

    Please note that, as an institution, we maintain the right to suspend services if a student consistently demonstrates a lack of effort, attendance, or cooperation in the program. Continuous lack of engagement or failure to adhere to the agreed-upon commitments may result in a review of the client relationship and, at our discretion, a termination of services without any refund of fees.

Termination of Services

  1. Termination by Presidio Education®
    We reserve the right to terminate services at our discretion, particularly in cases of non-compliance with these Terms and Conditions, inappropriate behavior, or non-payment. In such cases, no refunds will be issued.

  2. Termination by Client
    Clients may terminate services at any time by notifying Presidio Education® in writing. However, once services are terminated, no refunds will be issued under any circumstances. All classes that are scheduled or remaining after termination will be automatically forfeited. These classes will not be rescheduled, and no refund will be given for any services rendered or scheduled prior to the termination. Clients are still responsible for any outstanding payments for services rendered up until the point of termination, regardless of cancellation.

Indemnification

By agreeing to these Terms and Conditions, you agree to indemnify, defend, and hold harmless Presidio Education® and its employees, contractors, and affiliates from any and all claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our services, breach of this Agreement, or violation of any law.

Governing Law and Dispute Resolution

This Agreement will be governed by and construed in accordance with the laws of the State of California, United States, and any applicable federal laws, without regard to its conflict of law principles. Clients agree that any disputes arising out of or relating to this Agreement will be resolved exclusively through binding arbitration and not in a court of law. The arbitration shall take place in California, and the decision of the arbitrator(s) will be final and binding.

By agreeing to these terms, clients waive any right to pursue litigation in court, including any right to a jury trial.

Changes to Terms

Presidio Education® reserves the right to modify or update these Terms and Conditions at any time. All changes will be effective immediately upon posting to our website. It is the client's responsibility to regularly review these Terms for updates.
